Booking and Retainer: To secure your photography session, a 50% retainer of the total service cost is required at the time of booking, unless otherwise stated. This retainer is non-refundable and will be applied toward the total cost of the shoot.

Print Orders: All print orders are final. No refunds or exchanges are available unless the prints are damaged upon arrival. In such cases, photographic proof of the damage must be provided for a return to be processed. Orders may be canceled within 12 hours of purchase via email.

Travel Fee: For shoots located more than 100 miles from Colorado Springs, a travel fee will apply. Clients are advised to obtain a quote for travel costs prior to confirming their booking.

Weather Conditions: Shoots may be rescheduled due to extreme weather conditions at no fault of the photographer. We prioritize safety and the quality of both clients and the photographer, and we appreciate your understanding in these circumstances.

Photography Rights: All images captured by Mike Hunnisett Photography remain the intellectual property of the photographer. Images are licensed for personal use only to the client, unless a separate, pre-determined commercial shoot contract is in place.

Copyright Retention: The copyright for all images produced by Mike Hunnisett Photography is retained by the photographer. Any use of the images outside of personal use requires explicit permission from Mike Hunnisett Photography.

Culling and Editing: Mike Hunnisett Photography retains the right to edit and select the final images presented to the client. The process of culling and editing is an integral part of delivering the best possible outcome for our clients.

Limit of Liability: Mike Hunnisett Photography represents that reasonable care is taken with respect to capturing, developing, processing, storing, and delivering images. However, in the event that he fails to comply with the obligations of this contract, for any reason, including but not limited to events outside of his control or own negligence, his liability shall be limited to a refund of all payments made by the client. The limit of liability for a partial loss of original images shall be a prorated amount of the exposures lost based on the percentage of total number of original images.

REGARDING PHOTOGRAPHS:
WHAT YOU MAY DO:

• Display images on personal social sites, personal social media, and computers.
• Make prints for personal use. When printing please note that the actual color and/or brightness for a photo depends on individual computer settings and Mike Hunnisett is not responsible for color outcome.

WHAT YOU MAY NOT DO:

• Alter images in any way including cropping and photographic filters such as but not limited to Instagram and Facebook filters. This applies to any person altering the image including friends and family.
• Resell, re-license, sub-license, or redistribute without express written permission from Mike Hunnisett Photography LLC.
• Use the Media in any way, whatsoever, in which you charge money, collect fees, or receive any form of remuneration, without express written permission from Mike Hunnisett Photography LLC.
• Use the media in any advertising without express written permission from Mike Hunnisett Photography LLC.
• Use the media in a pornographic, obscene, illegal, immoral, libelous, or defamatory manner.
• Incorporate images into trademarks, logos, or service marks without express written permission from Mike Hunnisett Photography LLC.

Idemnification:

• PHOTOGRAPHER and CLIENT agree that PHOTOGRAPHER is under no obligation to capture any specific moment or pose or person(s) during the SHOOT. CLIENT is encouraged to provide a suggested photo list, but PHOTOGRAPHER has no liability for capturing any of the photos on the list.
• If PHOTOGRAPHER is unable to perform due to events outside its control, client agrees to indemnify PHOTOGRAPHER for any loss, however, all payments made by CLIENT will be returned in full.
• CLIENT agrees to indemnify and hold harmless PHOTOGRAPHER for any liability related to technological failure.
• CLIENT understands and agrees that PHOTOGRAPHER is required to retain copies of a reasonable number of photos for 200 days after the SHOOT.
• CLIENT will hold PHOTOGRAPHER harmless for any damage or injury caused by PHOTOGRAPHER's equipment.
• CLIENT agrees and understands that the quality of a photograph is subjective and PHOTOGRAPHER is not required to cater to specific aesthetic preferences of CLIENT.
